NFL Preview: New York Jets

The final team in my look at the 2013 NFL season in the AFC East is the New York Jets. Possessing what is in my opinion the worst roster talent-wise in the entire NFL, it's hard for me to imagine the Jets being anything but a cellar-dweller this year in the division. It will be a pretty big surprise to me if they don't end up with a top 5 pick in next year's draft. Their only competition for "league's worst roster" is the Oakland Raiders and Jacksonville Jaguars, and at least both of those teams have at least one stand-out player (for Oakland it's Darren McFadden, and in Jacksonville it's Maurice Jones-Drew), which is more than I can say for the Jets now that they've traded away their clear-cut best player, Darelle Revis, to the Tampa Bay Bucs. Let's take a look at the breakdown for the 2013 New York Jets:Key Additions: You know your team is either in a really bad situation or a really good one when your only key additions come via the draft. In the case of the Jets, it's the former. While they did address two key issues in the draft with their additions of Dee Milliner and Geno Smith, there were certainly more pressing issues that they could have addressed with these picks, and in my opinion, better players that they could have drafted if those were the positions they wanted to address. When I watched the combine, all I saw from Dee Milliner was some stiffness in his hips and an inability to catch the ball. Add to that the fact that he'd had a shoulder surgery prior to the draft that should keep him out of training camp, led me to believe (and I still do) that their were better options for the Jets at the cornerback position. Milliner will have to come in and be a contributor right away, and a spectacular one at that, if he's going to get Jets fans off his case about being the replacement to Revis. It's no small task for a rookie, and I have my doubts about whether Milliner is up to the challenge. When it comes to Geno Smith, he may have been the best of the quarterbacks in the draft, but I was never very high on him to begin with. Being a Big 12 fan, I watched a lot of Smith at West Virginia, and I never liked what I saw from him. I thought the only reason he was a first round pick was because of a relatively weak class of QB's this season, and as it turns out, he wasn't even a first rounder, falling to the top part of the second. I do not think that the Bills made a wise choice in taking E.J. Manuel over Smith, but if I had been a team looking for a quarterback, I would not have filled that position in the draft.Key Losses: The biggest loss that the Jets had this off-season was one that ultimately needed to happen. Darelle Revis was never happy with the Jets organization, and while being the best cover corner in the league, it never seemed like the organization was happy with him either. They never tried to negotiate a long-term deal with Revis, and while Revis' constant hold-outs may have alienated himself from the team and the front office, his play on the field certainly warranted being treated better than the organization did. It was time for Revis to move on from the Jets, and now that he's in Tampa with a nice new deal, I expect him to be much happier than he was in New York. The loss of Revis means that the Jets are left with a pretty bare cupboard both in the secondary and on the overall roster. Revis was clearly their best player, and with his departure, I don't even know who would hold that title now. Unless some of these rookies pan out far better than expected, the Jets are going to be a laughing-stock for years to come with this roster. What it means: As I alluded to in the introduction, I don't see any scenario in which the Jets are not the last place team in this division. Obviously I'm not going to pick my Dolphins to finish behind them. With all their recent struggles, I still think that the Bills have a much more talented roster overall than the Jets, and even with the recent arrest of Aaron Hernandez further depleting the Patriots pass-catchers, there's no way that Tom Brady and Bill Belichick let this team fall that far. I see the Jets finishing no better than 5-11 this season, securing themselves at least a top 10 pick, if not top 5, in next year's draft.Well, that's it for my look at the AFC East for next season. Come back for my next installment, as I switch both division and conference and take a look at the NFC North division, team by team.

Rolling Stones New Live Album Hits No. 1 in 11 Countries

Europe loves the Rolling Stones, reveals a look at the recent iTunes charts, which puts the band’s newest release, Hyde Park Live, at the No. 1 spot in 11 countries. The album, which captures the band’s final 50 & Counting final tour dates at London’s famous Hyde Park  on July 6 and 13, is dominating the iTunes charts in Austria, France, Germany, Greece, Italy, Luxembourg, the Netherlands, Norway, Spain, Sweden and Switzerland. The live record also hit No. 4 in the U.S. and the U.K. Hyde Park Live’s recent dash up the charts began July 22, when the Stones announced that the album would be available for a limited time only—August 19 as the cut-off date—and exclusively through iTunes. In an official statement on their website, the Stones camp said that the purpose of the limited-edition release is to ensure “that concert-goers, and fans new and old, can re-live their memories and experiences of these historic hometown shows.” The album puts a spotlight on the English rockers almost 44 years to the day since their first historic performance at Hyde Park in July of 1969, where they debuted new guitarist Mick Taylor and broke records for fan attendance. Will you join your European counterparts in purchasing this limited-edition project from Jagger, Richards and company?

New Orleans Ice Cream Company

Way back in October or November I got samples from the New Orleans Ice Cream Company. Then I had a baby. Then it was the middle of winter and even though I am a New Englander who likes ice cream year round, I thought it would be more appropriate to write about it in the spring when people really started to get in the mood for ice cream. Though I might argue that with NOICC's unique flavors, you'd probably be in the mood year round.I have to say of the samples I received my favorite was by far the Baked Alaska (vanilla bean ice cream with meringue pieces, strawberries, cake pieces, and meringue swirl -- what's not to love?) In fact, I was a little bummed it was also my dad's favorite because we kind of had to fight over it!Some of the other flavors were a bit more intense for me and made me realize I wasn't probably the best tester because I don't like alcohol flavors or coffee flavors too much, but the good thing is that I have great friends and family who are much bigger fans of alcohol and coffee and they were more than willing to try these flavors for me.In fact, one couple we had over tried some of the ice cream and walked off with the Cajun Rum and Raisin, the Brandy Milk Punch, and the Mississippi Debris. (Although I have to say, I was hesitant to let that Mississippi Debris go -- it was a a close second, full of everything and anything chocolate...)My mom loved the Coffee and Chicory and the Chocolate City. I knew I wouldn't be a fan of the Coffee and Chicory, since I don't like coffee, but I was disappointed to taste coffee in the Chocolate City, which gave no indication in it's description that it too contained coffee and chicory. (For those of you wondering what chicory is, as I was, basically chicory has a similar flavor to coffee and is used as a coffee flavoring or as a coffee substitute.) Nonetheless, my mom was delighted in both flavors as she loves coffee and chocolate. The Red Velvet Cake was one I really wanted to like, and while the description sounded so promising, there was something in the flavor that just wasn't working for me. The only thing I could think was the creole cream cheese ice cream. The Toasted Coconut was light and yummy, but nothing as unique and outstanding as some of the other flavors in their line up. (Though the Toasted Coconut did come in their unique limited edition packaging done by a local artist, I believe, which made it stand out...)A freezer case full of New Orleans Ice Cream Co.Oh to be so lucky to have this near me...Would I buy from the again? Yes, in a heartbeat.* The ice cream is rich and creamy, not at all icy. And this company has got to have the most unique flavors of cartoned ice cream I am aware of. In fact, I have a list of flavors I want to try: Lemon Doberge Cake, Mardi Gras Pie, Peach Melba, and Satsuma Dreamsicle. As well as have a taste of my heavenly Baked Alaska again.*Why the asterisk? Because New Orleans Ice Cream Company products aren't even available within 1,000 miles of me! I love it but I don't know if I can afford the high price of shipping every time I want to eat it. But maybe for a treat or a birthday present? Husband? Yes? Thanks, New Orleans Ice Cream Company for the AWESOME samples, I just wish you hadn't turned me onto a product that's now so hard for me to get! Kanye West - New Slaves (Live at Saturday Night Live)

Kanye West - "New Slaves" SNL Performance from Eric on Vimeo.Yeezy Season chegou!

New Skilled Person is New Matter

The German Bundesgerichtshof has added a new mosaic tile to the new case-law on late filing in the 2nd instance patent nullity proceedings (see earlier post here for some background). The contested patent related to heating mats for use in underfloor heatings and the German Patent Court had identified a mechanical engineer with university degree (Diplomingenieur) and experience in the development of heating mats as the relevant person skilled in the art.In the appeal, the patentee  argued that the person skilled in the art should be a craftsman experienced in laying the mats rather than the engineer. No reasons justifying the late submission were given. The Bundesgerichtshof rejected this argument as being late under the new procedural rules (and, besides of being late, as incorrect). This hints towards a strict application of the new rules and this blogger finds this decision surprising because the assessment of the inventive step including identification of the relevant skilled person is traditionally considered a question of law and not a question of fact in Germany.  Questions of law should not be considered late-filed.The full text of the decision can be found here (in German).
